Terms of Service
1. Acceptance of Terms
By accessing or using Wakeport ("Service"), provided by Daniel Hallman / Moosh Works ("we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you represent an organization or entity, you warrant that you have authority to bind that organization to these Terms.
2. Description of Service
Wakeport provides notification routing, challenge classification, and event delivery software. Wakeport connects to user-authorized external services (such as Gmail via Google OAuth 2.0 or SMS gateways), evaluates user-configured rules, and dispatches structured wake notifications to destinations specified by the user (such as local AI agents, Model Context Protocol servers, or webhook endpoints).
3. User Accounts and Authorized Integrations
To use Wakeport, you must:
- Connect only services and accounts that you own or are explicitly authorized to manage.
- Maintain the security and confidentiality of your credentials, encryption keys, and tokens.
- Be solely responsible for all activity that occurs through your connected accounts and configured destinations.
4. Acceptable Use Policy
You agree not to:
- Violate any applicable federal, state, local, or international laws or regulations.
- Violate third-party terms of service, including the Google APIs Terms of Service and Google API Services User Data Policy.
- Attempt to probe, scan, or compromise the integrity of Wakeport's services or underlying infrastructure.
- Use the Service to transmit unsolicited messages (spam), malware, or harass third parties.
- Attempt to bypass API quotas, authentication boundaries, or rate limits.
5. Third-Party Services and Google APIs
Wakeport integrates with third-party providers including Google. Your use of third-party platforms is governed by their respective terms and privacy policies. Wakeport is an independent software application and is not endorsed by or affiliated with Google LLC. Any changes to third-party API availability, terms, or policies may affect Service availability.
6. User Ownership of Data
You retain all right, title, and interest in and to your data. You grant Wakeport a limited, non-exclusive license to process your data strictly to the extent necessary to provide the features requested by you. We do not sell your data or use your communication content to train generalized machine learning models.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DANIEL HALLMAN OR MOOSH WORKS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100.00) OR THE AMOUNT PAID BY YOU TO WAKEPORT IN THE PRECEDING TWELVE MONTHS.
9. Termination and Disconnection
You may disconnect your accounts and terminate your use of Wakeport at any time. We reserve the right to suspend or terminate access to the Service at our sole discretion, without prior notice, if these Terms are violated or if required by security or legal obligations.
